Amendments and Addenda to the Law on State Duty and to the Enclosed Other Laws

At April 7 sitting of the NA Standing Committee on State and Legal Affairs, the legislative package on Making Amendments and Addenda to the RA Law on State Duty, on Making Amendment and Addenda to the RA Civil Proceedings Code and on Making Amendments and Addenda to the RA Law on the RA Administrative Proceedings Code was debated in the second reading.

The RA Deputy Minister of Justice Vahe Danielyan has noted that during the period from the first to the second reading it was proposed to reformulate the provision related to the amount of the state duty in case of the demand by currency.

A new privilege of exempting from state duty was established on cases of recognizing unknown missing and decease the missing serviceman, citizen as a result of military actions. A privilege was established on the issues of applications of adoption of the heritage of the deceased persons as a consequence of military actions.

According to the Deputy Minister, part of the proposals made by the deputy Artur Davtyan was accepted. It was proposed to define 100.000AMD state duty on the recognition of foreign arbiter judgments and judicial acts. “We think that it is a big amount. We proposed 50.000AMD in case of arbiter, 20.000AMD for judicial acts,” Danielyan said.

The deputy Arusyak Julhakyan proposed to design shorter period for the privilege of submitting a lawsuit on recognizing unknown missing, for example 10-day, to which the Deputy Minister positively responded. “We’ll envisage an opportunity to enter into force within short term. I will propose to observe the item of entering into force within the short term the remaining privileges, as we are on the threshold of the elections, and in case of applying to the court by the organization carrying out observation missions a privilege is also defined, we may enter those privileges earlier than 6-month general term,” the Deputy Minister underlined.

In his co-speech Artur Davtyan proposed his colleagues to vote for it.

As a result of voting the legislative package was endorsed by the Committee.
